2018 TALEBAR QUARTER HORSE PRODUCTION SALE

We want to Thank you for your participation and interest in our 2018 Fall Production Sale.

* Please notice, this website is used a lot for charity or fundraising auctions. The auction we are holding is not for that purpose. All Proceeds will go back to Talebar/ Goetz Ranch

***There are two Ranches selling in this Auction. Each ranch will handle their own sale.

Terms and Conditions of the sale
PLEASE READ BEFORE BIDDING. A copy of this contract will be emailed to you , if requested, following your approval to bid. You will be bound by these terms and conditions whether or not you have read them.

1. Buying Agreement:
a) I represent and agree that I am of legal age to form a binding contract.
b) I (hereinafter, referred to as Buyer) agree to these terms and conditions, and swear that all the information furnished is true and correct.
c) Buyer agrees to be responsible for any purchase made or actions taken by an Agent authorized by me to act on my behalf,
d) Buyer agrees that this registration to bid is not assignable without the express written approval of Talebar via email. All accounts must have a physical address and phone number.
e) Buyer agrees to make any sale transaction for this entry through Paypal, Cash or Check. Payments must clear within 48 hours after the end of the sale.
f) Buyer agrees that if they have the winning, final bid, or accepted bid in auction subject to Talebar or Goetz Ranch Confirmation depending on which lot is purchased. When the buyer bids, the Buyer has entered into a binding agreement to purchase the horse.
f) Talebar /Goetz Ranch has the right to refuse any and all bids for any reason and/or NO SALE a horse.

2. RESPONSIBILITY: By placing a bid in this auction Buyer is indicating they have examined or researched a horse to their satisfaction. Prior to Bidding,
a) Buyers may contact Sellers with questions on a certain horse.
b) Buyers may arrange to view the horses before the end of the sale at the sellers ranch by appointment.
c) Schedule to have a veterinarian perform a pre-purchase examination, before the end of the sale at the expense of the buyer. Once the sale is over you are buying the horse AS IS. No Returns or Refunds or scheduled Vet Checks.
d) Buyer may hire an agent or equine professional to inspect and evaluate the horse before the (2) two days before the end of the auction. This must be a scheduled appointment.

3. REPRESENTATION: Sellers of each ranch; will representation each horse at the best of their abilities. Some representations on disposition and handling are the opinion of Sellers and given only as an indication of the horse’s capability. Buyer should inspect, examine and research horse to their satisfaction to make sure it fits their needs. Sellers will disclose any known conditions or known flaws major enough to affect the horse’s performance or health. All Horses are offered for sale according to the laws of the State of South Dakota. They are sold AS IS, NO RETURNS OR REFUNDS. Sellers also agrees to not have given any drugs to alter soundness or temperament.

4. NO IMPLIED WARRANTIES: There is no warranty expressed or implied by the sellers, as to the performing soundness, merchantability or fitness for any particular purpose of any horse offered in this sale, other than those made specifically by the sellers. ALL HORSES ARE SOLD “AS IS” WITH ALL EXISTING CONDITIONS AND DEFECTS.

5. TRANSPORTATION FROM SELLER TO BUYER: Buyer is responsible for cost and arrangements for transportation of horse from Seller to Buyer. Soon after purchase Sellers will contact Buyers: directly to schedule pickup of horse, Make payment arrangements and put them in contact with a shippers/transporters if needed.

6. RELEASE OF HORSE TO BUYER: Sellers shall not release a horse to a Buyer until Buyer has made full payment for the horse and funds have been verified and payment has cleared. Could take up to a few weeks for all payments to clear.

7. RISK AND RESPONSIBILITY: Buyer assumes all risk, responsibility and expense for the horse at the end of bidding or, if sold pending confirmation by Sellers . Talebar agrees to provide basic board and care for up to 14 days at no additional charge. Beyond 14 days, Buyer will be responsible to pay for board, with the exception of the 2018 foals, at a reasonable cost determined by the sellers, plus any other expenses that may be required to maintain the horse until Buyer takes possession or has the horse picked up from the seller. This excludes 2018 foals which need to be picked up on or before October 31, 2018 at Talebar and the Goetz Ranch. They will not be halter broke. Coggins and health papers will be covered. Starting November 1st the Goetz Ranch will accept $100 board which is due at the beginning of the month. Talebar horses will be sold with a halter and all Talebar horses sold must be picked up by October 31, 2018 or the Seller has the right to terminate the sale and no refund or reimbursement will be returned. Sellers recommends the buyer obtain Full Mortality Insurance on horses immediately after purchase, however, this decision and risk rest solely with the buyer. Weaning of foals may happen around October 15, 2018.

8. BIDDING & EXTENDED BIDDING: Bidding will open SEPTEMBER 8 AT 12:00 PM CDT and will close SEPTEMBER 15 AT 5:00PM CDT. We will be having an extended bidding options automatically extends the end time of an item by 3 minutes when it receives a bid during the final 3 minutes. This process repeats until no new bids are received during the final 3 minutes of the horse for a maximum of 30 minutes. Alternatively, a Bidder may place maximum (proxy) bids where they declare the maximum dollar amount they want to bid, and the computer will bid on their behalf until they have successfully purchased the horse or the asking price exceeds the amount of their maximum bid. The Sellers are not liable for systems /bidding fails. Please allow enough time for bidding. This action is hosted by www.32auctions.com and is not liable for any products sold on it’s site. Facebook or other social media is also not sponsoring our auction.

9. SELLING:
Horses will sell to the highest bidder at the time ending September 15, 5:00 pm CDT.
Sellers will have 24 hours to confirm and accept the final price following the close of the auction and to decide to accept the final bid in the auction. Sellers have the right to refuse all bids for any reason or no sale the horse.

10. BIDDING ERRORS: You should make sure to review all bids before and after submitting. Once you hit “submit” or “bid” you are liable for that payment amount.

11. PAYMENT: Once bidding is closed an invoice will be emailed to Buyer. Payment in full must be made within (3) banking days after the sale is closed. Payments will be made to Talebar / Goetz Ranch in the form of MasterCard, Visa, American Express or Discover credit cards, Paypal, (3% fee will be added to sale price) Bank Check or Cash. Sellers will be contacting you to find out how you want to manage payment, but it is best to include that when registering to bid. Each seller is holding their own form of payment options. EXAMPLE: If you purchase a horse from Talebar and another from Goetz ranch. You will be paying each ranch separately. All payment and contact information is kept confidential and will not be shared.

12. DEFAULT ON PURCHASE - If any person shall purchase a horse and not pay for it as prescribed above, Sellers shall have the right to resell the horse or at their option bring legal action in which event buyer agrees to pay all cost of such suit together with reasonable attorney fees as fixed by the court. In the event of resale the defaulting buyer agrees to pay all costs of resale and price deficiency, if any. Interest of 1-1/2% per month will be charged on the unpaid balance of any account not paid for as set forth in these conditions.

13. REGISTERED HORSES: papers will be held by Seller until all payments clear the bank (up to 21 days) at which time they will be mailed, with completed transfer reports to the buyer. Typically Registration Papers are mailed to Buyers 10 (ten) business days.Papers will be released when a horse has been transported and/or all fees have been paid to the appropriate seller. If buyer picks up horse and pays in cash the papers will be handed over at this time. Goetz ranch horses are selling on AQHA application.

14. COGGINS / HEALTH REPORT: Sellers will provide or schedule a Coggins report / test before the pickup date if going out of state. Buyer will be responsible for obtaining the Interstate Health Certificate for transportation. Sellers can assist in setting up an appointment to get the appropriate health certificates so that the transition happens smoothly. Goetz ranch horses are being sold with a worming / strangles vaccination/
Talebar ranch horses will be provided with Coggins if out of state. Vaccinations /worming at the request of the buyer for an additional charge.

15. Sellers reserves to right to update and change the terms and conditions / contract /catalog at any time before the beginning of the sale.

Every effort has been made to insure the correctness of the catalog and information for the sale. Sellers assume no responsibility for errors or omissions. All persons taking part in the sale or viewing horses live on the ranch do so at their own risk. The owners of the horses, property, or auction hosting site, assume no liability, legal or otherwise. Each ranch is in charge of individually connecting with the buyers of their lots.
