Barn Finds: A Sale of Deaccessioned Objects on Behalf of the Historical Society of Princeton (Antique Porcelain & Pottery, Paintings & Prints, Toys & Dolls, Medical Instruments, Books, Furniture and More)

Following an exhaustive five-year-long review of its collection of more than 3,000 objects, the Historical Society of Princeton will be selling over 400 deaccessioned items in a Live Auction, in approximately 150 lots. Consistent with established ethical guidelines, all proceeds will be restricted to the direct care of HSP’s important remaining collections.

TERMS OF SALE
The property in this auction, which may be amended by auction room notice or announcement, will be offered for sale by the Historical Society of Princeton (“HSP”) under the following terms and conditions:

1. Bids for any and all Lots shall be made in accordance with the procedures set forth in the print catalog of Lots, on the absentee bid form, and on 32auctions.com.
2. All Bidders must register and receive a bidding number from the HSP prior to bidding at auction. Bids are accepted only from registered Bidders.
3. Lots may be subject to a Reserve, an amount below which the Lot will not sell. Lots subject to a Reserve are noted in the catalog of auction Lots.
4. All property is sold "AS IS" and without any right of return. HSP make no warranties, express or implied, or representation of any kind or nature with respect to the property, and in no event shall it be responsible for the correctness of or be deemed to have made any representation or warranty of merchantability, description, genuineness, attribution, provenance, or condition concerning the property, and no statement in the catalog or made at the sale or in the invoice or elsewhere shall be deemed such a warranty or representation or an assumption of liability. HSP shall not be liable for any incidental or consequential damages arising from the sale of any property.
5. Unsold Lots will be made available for sale in the October 5 tag sale which will likewise be governed by the terms set forth here as Paragraphs 4; 14; 16; 17; 18; 19; and 20.
6. The descriptions in the catalog are solely for the convenience of the Bidders and for the purpose of identification. No warranty or representation is made that the items shall conform to the description.
7. The estimates provided in the catalog are neither a representation nor a prediction of the final bid price that will be realized at auction, or the price at a post-auction sale or upon resale, which may be substantially different from the estimates. The HSP shall not be liable for any discrepancies.
8. The HSP reserves the right to withdraw a Lot from auction for any reason and with no liability whatsoever for such withdrawal.
9. Absentee bids will be accepted prior to the auction on 32auctions.com and must be received no later than October 4 at 10am. Absentee bids will also be accepted in person during preview hours and must be received no later than October 4 at 5:15pm. The HSP shall not be responsible for failing to execute absentee bids or errors relating to the execution of such bids.

10. Generally, bidding increments are made as follows. However, the auctioneer has the sole and exclusive power, discretion, and authority to regulate the bidding and change the bidding increments.
• $10 until $100 is reached
• $25 until $500 is reached
• $50 until $1,000 is reached
• $100 until $3,000 is reached
• $250 until $5,000 is reached
11. As used in these Terms of Sale, the term "final bid price" means the price at which a Lot is declared sold by the auctioneer, as he in his sole opinion may determine. The term "purchase price" means the sum of the final bid and sales tax, if any.
12. Upon the fall of the auctioneer’s hammer an agreement for the sale of the Lot is created between the successful Bidder and the HSP. The Bidder acknowledged by the auctioneer shall be the official Buyer.
13. The auctioneer has the right to reject any bid. In the event of a dispute between Bidders, the auctioneer may determine the successful Bidder or to reoffer and resell the Lot in dispute. Should there be any dispute after the sale, the HSP’s record of final sale shall be conclusive.
14. All purchases must be picked up at the HSP, located in New Jersey, and will be taxed at the New Jersey state tax rate, currently 6.625%. If you have a valid resale certificate you will need to complete a NJ ST-3 or ST-NR sales Tax Form.
15. On the fall of the auctioneer's hammer, the Buyer assumes all risk and responsibility for the Lot and pays the full purchase price. If the Buyer fails to comply with such requirement, the Lot may, at the auctioneer's discretion, be put up and sold again.
16. The HSP will provide the Buyer with a paid receipt which must be presented at check-out and before claiming his Lot.
17. Payment shall be made in US Dollars, by check or by credit card with valid ID (passport or driver’s license) which will be photographed by HSP and deleted from its computer files once the check has cleared. Upon our receipt of payment in full in good and clear funds from the Buyer, title to a Lot transfers. If payment is made by check, title shall not transfer until the check has cleared.
18. The full purchase price of each Lot shall be paid for and the Lot removed from the HSP premises no later than Saturday, October 5 at 3PM. Removal of purchased property is the responsibility of the Buyer.
19. If any applicable conditions herein are not complied with by the Buyer, the HSP may, in addition to asserting all remedies available by law, including the right to hold the Buyer liable for the purchase price, either cancel the sale, retaining as liquidated damages any payment made by the Buyer, or resell the property.
20. All Bidders and Buyers agree to submit to the jurisdiction of the courts of the State of New Jersey with respect to any dispute arising in connection with this auction.
